GENERAL TERMS AND CONDITIONS OF DIRECT AND DISTANCE SALE
SINGLE TICKET(S) FOR HOME MATCHES OF THE OM WOMEN’S FIRST TEAM SEASON 2025/2026 (“GTC”)
PRELIMINARY ARTICLE: DEFINITIONS:
For the purposes of these terms and conditions, whether in the singular or plural, the capitalized terms shall have the following meanings:
“OM”: SASP OLYMPIQUE DE MARSEILLE [Marseille Trade and Companies Register n° 401 887 401].
“Buyer”: any individual or legal entity, acting through its legal representative or any duly authorized person for this purpose, who has personally purchased one or more Ticket(s) for a Match via Remote Sale and/or Direct Sale.
“Holder”: any individual or legal entity who, not having personally purchased one or more Ticket(s) for a Match via Remote Sale and/or Direct Sale, may possess, by any means and for any reason, one or more Ticket(s).
“Team”: refers indistinctly to the OM women’s first football team.
“Match”: home football match actually played by the Team in any competition (official or friendly) for the 2025/2026 season.
“Website”: Official OM website accessible via the URL www.om.fr, and/or any other website exclusively or non-exclusively dedicated to the purchase of Tickets.
“Stadium”: refers to the municipal Francis Turcan stadium, located at 31 Chem. de Paradis, 13500 Martigues, or any other venue or sports complex replacing it, where the Team would play the Match, provided that OM expressly announces the validity of Tickets for the Match(es) held in such other venue or sports complex.
“Individual(s)”: any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal or agricultural activity.
“Legal Entity(ies)”: any natural or legal person, public or private, acting for purposes falling within the scope of their commercial, industrial, craft, liberal or agricultural activity, including when acting on behalf of another professional, on the one hand, and any legal entity acting for purposes not falling within the scope of their commercial, industrial, craft, liberal or agricultural activity, on the other hand.
“Ticket(s)”: contract(s) purchased via Direct Sale or Remote Sale granting access to the Stadium for a single Match. Subject to and without prejudice to the provisions of Article 7, it may take the form of a Thermal Ticket, a Printable Ticket, or an M-Ticket depending on the purchase channel.
“Remote Sale” (RS): distance purchase of one or more Ticket(s) via the Websites.
ART. 1: PURPOSE, APPLICABILITY, BINDING NATURE OF THE GTC
These GTC apply to Individuals and Legal Entities, whether they are Buyers and/or Holders. Exceptionally, the GTC include provisions strictly intended for Individuals and provisions strictly intended for Legal Entities, which are systematically written in italics.
The GTC govern the relationship between, on the one hand, the Buyer and/or Holder and, on the other hand, OM regarding the purchase via RS and/or possession of one or more Ticket(s) which, through one or more medium(s) on which the seat number appears, solely grants the right to access the Stadium to attend the corresponding Match.
They are brought to the knowledge of and/or sent and/or delivered to each Buyer through RS and communicated to each Holder according to the instructions on the back of the Ticket. They are also freely accessible on the website “www.om.fr”.
The purchase and/or possession of one or more Tickets constitutes full and unconditional acceptance of the GTC to the exclusion of all other documents (brochures, catalogs, and other writings) issued by OM, which have only indicative value.
Any contrary condition opposed by the Buyer and/or Holder shall, in the absence of express acceptance, be unenforceable against OM, regardless of the time it is brought to OM’s attention.
Additions, erasures, modifications, or deletions made to the GTC without OM’s formal approval are unenforceable against OM.
OM’s failure to invoke any provision of the GTC shall not be interpreted as a waiver to invoke said conditions later.
By accepting the GTC, the Buyer and/or Holder adheres to the Stadium’s internal regulations displayed at the Stadium entrances and acknowledges having taken note thereof.
OM reserves the right to modify the GTC at any time and without prior notice. The GTC applicable to the Buyer and/or Holder are those in force on the date of Ticket purchase.
ART. 2: GENERAL PROVISIONS REGARDING THE TICKET(S)
2.1 Each Ticket indicates the seat it grants access to in the Stadium. OM commits to ensuring that the Buyer and/or Holder has access to the seat indicated on the Ticket in the Stadium, only for the Match. If the seat is occupied by a third party, the Holder must contact nearby stewards. Furthermore, the Holder acknowledges that for security purposes, OM may need to verify their identity.
2.2 OM reserves the right, at any time and exceptionally, to modify the seat allocated by the Ticket or any other access document, notably when such modification is required for organizational and/or safety reasons, including legal and regulatory requirements, competition rules, organizer’s demands (e.g., reservations by European football authorities), or force majeure events.
2.3 In exceptional circumstances requiring a change of the initially scheduled Stadium, such as unplayable pitch, administrative closure, disputes with the Stadium owner, etc., OM reserves the right to hold the Match in any other stadium than the Orange Vélodrome.
2.4 In the case of application of Articles 2.2 and/or 2.3, OM shall allocate the Holder, as far as possible and within available seats, a seat as equivalent as possible to the one indicated on the Ticket at no additional cost, regardless of location, which is expressly agreed and accepted by the Holder. For multiple adjacent Tickets, OM shall use best efforts, within available seats and considering organizational and safety constraints, to seat them together.
2.5 For each Match, Ticket sale dates, including any limited priority periods for 2025/2026 season subscribers, are set by OM and may differ by distribution channel. Sale dates are available on the Website and may change at any time without OM liability.
2.6 OM alone determines the stands or sectors of the Stadium subject to Ticket sales, the number of seats, and available Ticket types per sector. Sales are therefore made per stand/sector within seat availability.
2.7 The Holder may subscribe to additional services at the Match (e.g., food & beverage packages, parking mobility pass) offered by OM providers via OM platforms or otherwise. Holder acknowledges that relations with such providers are governed by specific terms for those services, to which OM remains a third party. In case of contradiction or absence of such terms, the GTC provisions shall supplement them.
ART. 3: PRICE AND NUMBER OF SEATS
3.1 Ticket price is indicated in euros, VAT included, according to the rate in effect on the date of purchase, and all other taxes or newly created/evaluated taxes. It is firm, final, non-refundable, fully payable in advance in one installment. Payment is made in euros, regardless of the country of origin. For RS, the VAT-inclusive price excludes handling and shipping fees indicated in Article 7.2.3. Price is determined by OM based on the Match and seat category. Displayed prices apply at the time of purchase.
3.2 Unless otherwise indicated, the total number of seats per Buyer cannot exceed two (2) per Match. Violating Buyers may have some or all Tickets canceled, to be returned if necessary.
3.3 Ticket(s) remain OM property until full payment. In case of payment default, OM reserves ownership rights and may deactivate Ticket(s) until payment is made. Payment is deemed completed only when fully received. OM may refuse future orders if disputes exist.
3.4 Any costs incurred by Buyer and/or Holder (travel, accommodation, or ancillary costs) are the sole responsibility of the Buyer and/or Holder.
3.5 For Legal Entities, pursuant to Article L. 441-10 of the Commercial Code, late payment automatically incurs penalties at ECB refinancing rate plus 10 percentage points per day, plus a fixed recovery fee of €40. Penalties are payable without reminder.
ART. 4: PURCHASE PROCEDURE AND AVAILABILITY OF TICKETS
4.1 Common provisions for Direct Sale and Distance Selling (VAD)
An exhaustive list of Ticket distribution channels can be obtained upon request from OM by sending a letter to the customer service mentioned in Article 16 of the CGV. Only those listed are authorized to offer Tickets, to the exclusion of all others. OM reserves the right to limit distribution channels depending on the Matches. The information provided by the Buyer during the order is necessary for its validity and binds them. The law punishes anyone committing fraud or making false statements (Art. 441-1 of the Penal Code). OM cannot be held responsible for errors in these details. No Ticket will be issued to anyone subject to an administrative or judicial Stadium ban. Any use of a Ticket by a person subject to an administrative or judicial Stadium ban is also prohibited. Furthermore, pursuant to Article L. 332-1 of the French Sports Code, OM is authorized to establish automated processing of personal data of individuals who have not complied or are not complying with the CGV or the Stadium’s Internal and Health Regulations and to refuse or cancel Ticket issuance or access to the Stadium. In any case, whatever the sales channel or payment method used, by confirming their order, the Buyer acknowledges having read and accepted in full the CGV without reservation.
4.2 Specific provisions for Direct Sale:
Unless otherwise indicated by any means, at the time of Ticket purchase, the Buyer may choose their seat among the still available seats in the category in which they wish to purchase their Ticket.
4.3 Specific provisions for Distance Selling (VAD):
Ticket(s) purchase is made in real-time on the Sites. In this context, the server informs in real-time of Ticket availability at the time of the order. The order will be definitively confirmed upon receipt by the Buyer of the email sent by OM summarizing the order details, thereby confirming that the Ticket(s) purchase has been completed. To this end, the Buyer acknowledges being informed of the intrinsic characteristics of the Internet and, in particular, the difficulties that may occur at certain times of the day in accessing the Sites (poor connections, saturated communication nodes…) for reasons entirely beyond OM’s control, which cannot therefore be held responsible for incidents limiting access to the Site. It is specified that the Buyer’s express acceptance of the CGV for a sale on a Site is formalized during the ordering process via an electronic agreement mechanism (opt-in).
ART. 5: TICKET DELIVERY
5.1 OM delivers the Ticket(s) to the Buyer according to the method chosen at the time of purchase, from the options offered by OM (electronic Ticket, postal delivery, counter pickup, etc.).
5.2 For Distance Selling (VAD), OM commits to delivering the Ticket(s) to the address provided by the Buyer within the deadlines indicated during the ordering process. Delivery times are given for information purposes only and constitute an obligation of means. OM shall not be held responsible for delays due to postal services, technical difficulties, force majeure, or incorrect information provided by the Buyer.
5.3 The Buyer is responsible for the receipt and storage of the Ticket(s). OM shall not be held liable for lost, stolen, or damaged Ticket(s) once delivered.
ART. 6: TICKET USAGE
6.1 The Ticket grants access to the Stadium for the Match indicated on the Ticket, on the date, time, and sector specified. Any attempt to use the Ticket outside these conditions will result in denial of entry without compensation.
6.2 The Buyer and/or Holder must comply with the Stadium Internal Regulations and any health and safety measures in force. OM reserves the right to refuse entry or remove any person not respecting these rules, without refund.
6.3 Tickets are strictly personal and non-transferable, except as expressly permitted under Article 9. Any resale or transfer in violation of these terms may result in Ticket cancellation without refund.
ART. 7: TICKET CANCELLATION AND MODIFICATION
7.1 OM may modify or cancel a Match due to force majeure, safety reasons, regulatory obligations, or other events beyond its control. In such cases, OM will inform the Buyer using the contact information provided at the time of purchase.
7.2 If a Match is canceled and not rescheduled, the Buyer may request a refund of the Ticket price only. No compensation will be due for incidental expenses such as travel, accommodation, or related costs.
7.3 Ticket modification, such as changing the seat category or the date, is possible only if explicitly allowed by OM and under the conditions specified at the time of the request.
ART. 8: PROHIBITION OF COMMERCIAL EXPLOITATION
8.1 Tickets may not be used for commercial purposes (advertising, promotional campaigns, contests, sweepstakes, etc.) without prior written authorization from OM.
8.2 Any violation of this Article may result in Ticket cancellation without refund, legal action, and potential damages.
ART. 9: TICKET TRANSFER AND RESALE
9.1 The resale of Tickets for profit, including via online platforms or marketplaces not authorized by OM, is strictly prohibited.
9.2 Transfers between individuals are permitted only within the limits and procedures authorized by OM. OM reserves the right to deactivate any Ticket that is resold or transferred in violation of this Article.
ART. 10: LIABILITY
10.1 OM is responsible for the proper execution of the sale of Tickets and access to the Stadium in compliance with the CGV.
10.2 OM shall not be held liable for:
- Incidents caused by the Buyer or third parties;
- Force majeure events, including strikes, weather conditions, or governmental decisions;
- Consequential damages, including travel, accommodation, or personal expenses;
- Unauthorized resale or misuse of Tickets by the Buyer or Holder.
ART. 11: PERSONAL DATA
11.1 OM collects and processes personal data of Buyers and Holders to manage orders, access control, safety, and communication related to Tickets and Matches.
11.2 Personal data may be shared with authorized service providers and partners, solely for purposes directly related to the execution of the order and the provision of services.
11.3 Buyers and Holders have the right to access, rectify, and request deletion of their personal data, in accordance with applicable law. Requests must be addressed to the OM customer service indicated in Article 16.
ART. 12: INTELLECTUAL PROPERTY
12.1 All elements of the Ticket and related materials (design, logos, content) are the property of OM or its licensors and are protected by intellectual property laws.
12.2 Any reproduction, representation, or use without prior authorization is prohibited and may lead to legal action.
ART. 13: GOVERNING LAW AND JURISDICTION
13.1 The CGV and any disputes arising from Ticket purchase or use are governed by French law.
13.2 Any litigation shall be submitted to the competent courts of Marseille, France, unless mandatory legal provisions dictate otherwise.
ART. 14: FORCE MAJEURE
14.1 OM shall not be held liable for partial or total non-performance of its obligations if caused by an event beyond its control, including natural disasters, strikes, governmental measures, pandemics, or technical failures.
14.2 In such cases, OM may suspend or cancel the service and inform Buyers as soon as possible. Refunds, if any, are limited to the Ticket price only.
ART. 15: FINAL PROVISIONS
15.1 If any provision of the CGV is declared null or unenforceable, the remaining provisions shall remain in full force and effect.
15.2 OM reserves the right to update the CGV at any time. The version applicable is the one in force at the time of Ticket purchase.
15.3 By purchasing a Ticket, the Buyer acknowledges having read, understood, and accepted these CGV in full.
ART. 16: VIDEO SURVEILLANCE
The Buyer and/or Holder is informed that, for their safety, the Stadium is equipped with a video surveillance system operated under the control of Judicial Police Officers, and whose images may be used in the event of legal proceedings. OM may collect and process data transmitted by the Prefects in accordance with Articles R. 332-2 and R. 332-7 of the French Sports Code.
The Buyer and/or Holder is also informed that OM may process addresses and photographs of individuals subject to stadium bans, provided that such data were collected by legitimate means, in particular during subscription to a season ticket or the purchase of an access ticket, insofar as this information is relevant for identifying persons subject to a stadium ban and for informing them of their rights.
In this context, OM may collect data relating to:
- Identification of individuals (last name; first name; address; date and place of birth; photograph);
- Convictions or security measures, specifically:
- In the case of a judicial stadium ban: date of the decision and duration of the additional penalty;
- In the case of an administrative stadium ban: prohibited stadiums and surrounding areas, type of sports events concerned, date and validity period of the prefectural ban, and, where applicable, obligation to respond to summons from authorities or persons designated by the prefectural authority.
With regard to photographs that may be collected, this data may not be used to implement a biometric facial recognition system. A right of access is granted for the duration of image retention specified in the prefectural authorization of the system, in accordance with Article L. 253-5 of the French Internal Security Code.
For the indicated purpose, personal data collected on this basis cannot be retained beyond the duration of a stadium ban imposed by the judicial or administrative authority. Individuals concerned have the right to access, rectify, and object to the processing of their personal data, which can be exercised at the following email address: dpo@om.fr.

ART. 18: MANAGEMENT OF STADIUM BANS
It is also recalled that under Article L. 332-1 of the French Sports Code:
"For the purpose of contributing to the security of sporting events, organizers of such events may refuse or cancel the issuance of access tickets to these events or deny access to persons who have violated or violate the provisions of the general terms of sale or internal regulations regarding the safety of these events. To this end, organizers may establish an automated processing of personal data relating to the infringements listed in the penultimate paragraph of this Article, under conditions set by a decree of the Council of State after reasoned opinion and publication by the National Commission on Informatics and Liberty (CNIL)."
Within this framework, the Holder is informed that, pursuant to Deliberation No. 2015-118 of April 7, 2015, granting a unique authorization for the processing of personal data by associations, sports clubs, and federations for the management of stadium bans imposed by judicial or administrative authorities (AU-042), and to ensure the safety of participants and spectators, OM may rely on this unique authorization (No. 42). This authorization allows associations, clubs, and sports federations to create and use lists of individuals subject to stadium bans imposed by judicial or administrative authorities.
Using data transmitted by territorially competent Prefects in accordance with the Sports Code, the responsible parties may refuse to issue an access ticket to these persons or prevent them from entering a venue where a sporting event is organized, provided that the stadium ban concerns the venue or the event in question. This file is declared to the CNIL.
ART. 19: APPLICABLE LAW – DISPUTE RESOLUTION – CONSUMER MEDIATION
This contract is strictly governed by French law.
Any dispute regarding the execution or interpretation of these terms and conditions must be notified to OM by registered letter with acknowledgment of receipt at the following address: Customer Service – Olympique de Marseille, Robert Louis-Dreyfus Training Center, 33 Traverse de la Martine, 13012 Marseille.
OM and the Buyer will then make every effort to reach an amicable agreement.
In accordance with Article L. 612-1 of the French Consumer Code, every consumer has the right to use a consumer mediator free of charge to amicably resolve a dispute with a professional. Pursuant to Articles L. 616-1 and R. 616-1 et seq. of the Consumer Code, the contact details of the consumer mediator applicable to OM, where complaints related to this contract may be submitted, are: SAS MEDIATION SOLUTION, 222 chemin de la Bergerie, 01800 Saint Jean de Niost, accessible via https://sasmediationsolution-conso.fr.
In the absence of an amicable agreement between OM and the Buyer, French courts shall have exclusive jurisdiction.
